Digital Delivery: Probate

I, David Barniville, President of the High Court, having consulted with the Chief Executive Officer of the Courts Service, in exercise of the powers conferred on me by  Order 117, rule 18 of the Rules of the Superior Courts, direct as follows:

  1. With effect from the 31st day of October 2025, I authorise the use of digital delivery (as defined in the Rules of the Superior Courts) in respect of the following -

    Where the date of death is on or after the 5th day of December 2001 (a) documents filed in connection with applications for grants of representation to the Probate Office, Dublin with the exception of wills, codicils and other testamentary documents, the original of which must be filed by personal delivery or by non-personal delivery in hard copy and (b) documents issued by the Probate Office, Dublin in connection with such applications.
     
  2. Authorised digital delivery is subject to the available functionality from time to time of the Courts’ digital portal (namely, the “network” referred to in  Order 125, rule 1 of the Rules of the Superior Courts).
